Council gives First Reading to backyard suite bylaw amendments

At today’s regular City Council meeting, Council gave First Reading to proposed amendments to the Zoning Bylaw that would change how Backyard Suites are regulated in the city.

Administration presented proposed changes in line with recommendations from the Municipal Planning Commission (MPC), Council direction, and community engagement, and aim to improve clarity, ensure compatibility with existing neighbourhoods, and support diverse housing options in Red Deer. At the meeting, Council made further amendments to the proposed changes.

The review of Backyard Suite regulations was initiated after the MPC raised concerns in February 2025. The commission had reviewed two applications that requested large variances to height and size limits for Backyard Suites. These applications highlighted inconsistencies and limitations in the existing regulations – particularly in older neighbourhoods with smaller principal dwellings or unique character.

In response, Council directed Administration to review the regulations and return with proposed amendments addressing four key areas: height, floor area, treatment in historic neighbourhoods, and attic/livable space.

 Following Council’s amendments, key proposed changes include:

  • Building height: Maximum height of 5.5 m for Backyard Suites built at grade, or 7.4 m for Backyard Suites built over a garage. 
  • Introducing a maximum floor area of 75m² (807 ft²), while retaining the existing 75% of the principal dwelling rule – whichever is less.
  • In any neighbourhood with character statements and overlays, Backyard Suites shall be subject to these regulations.
  • Discouraging liveable attic space by controlling overall height and size, addressing concerns without redefining “storey.”
  • Variance Powers: Any regulation in the bylaw relating to Backyard Suites may be relaxed by the Development Authority to a maximum of 15% in neighbourhood with Overlays or Character Statements.

“These proposed amendments are the result of a thorough review, including comparison with other municipalities and thoughtful community dialogue,” said Emily Damberger, City Planning and Growth Manager. “We heard clearly that residents value the flexibility that Backyard Suites bring to the housing market – but they also want assurance that new development fits well into their neighbourhoods.”

In June, The City conducted engagement activities to gather input, including a survey and a targeted session with residents from Parkvale, Woodlea, and Waskasoo. Key concerns included impacts on privacy, sunlight, neighbourhood character, and the visual scale of Backyard Suites.

The proposed changes align with Red Deer’s Municipal Development Plan and support goals under the 2023–2026 Strategic Plan, particularly those focused on community wellbeing, infill housing, and neighbourhood vibrancy.

A Public Hearing is scheduled for September 15, 2025, providing residents an opportunity to formally share their input before Council considers the proposed bylaw for second and third readings. In the coming days, details will be available at reddeer.ca/publichearing outlining how citizens can provide their feedback, either in writing or in person at the Public Hearing.
